Employment & Pension Law Department - EEA reviews by Director-General


We have noticed an increase in section 43 reviews. In terms of section 43 of the Employment Equity Act, the Director-General's office may request a meeting with the employer to consider its efforts in implementing its equity plan and its general compliance with the Act. There also appears to be a trend of treating any discrepancies in the equity plan as intentional misrepresentation.
