Moving Children During Lockdown- Amendments to the Regulations

There has been a further amendment to the regulations in terms of the Disaster Management Act. Previously, movement of children between co-holders of parental rights and responsibilities during the lockdown was prohibited, unless arrangements are in place for a child to move from one parent to another in terms of:

  1. a court order; or
  2. a parenting plan registered with the Family Advocate.

As of 16 April 2020, the Regulations have been amended by the inclusion of a further exception, namely:

  1. The coholder of parental responsibilities and rights in possession of a birth certificate or certified copy of a birth certificate of the child or children to prove a legitimate relationship between the coholders of parental responsibilities and rights.

The same provisos apply.
