Joint Liability of Unions and its Members for delictual claims occasioned by an unprotected strike

The recent judgment of Algoa Bus Company (Pty) Ltd v Transport Action Retail and General Workers Union (Thor Targwu) and another (2015), will without a doubt cause union officials to be cautious when faced with interdicts halting unprotected strikes and further encourage them to take control of unruly members who seek to run riot during this period.

The Labour Court, in this instance, ordered the union and its members to pay R1.4million in damages as a direct result of the union ignoring the interdict and failing to persuade their members to return to work.
